ALGA Alert – Legal Opinion on the Fair Work Commission’s Road Transport Contractual Chain Order

On 20 April 2026, ALGA advised that the Fair Work Commission had issued a Road Transport Contractual Chain Order (RTCCO) to set rules for fuel cost recovery across road transport contractual chains. Feedback from local government indicates the Order is creating financial pressure, administrative burden and implementation uncertainty for councils.

ALGA is currently coordinating a national local government response to the RTCCO, and as part of this work is sharing recent legal advice from Mallesons Lawyers (provided through LGNSW) to support councils in understanding the Order’s practical implications.

This forms part of a broader coordinated effort with state and territory associations, including preparation of sector-wide evidence and engagement in the Fair Work Commission’s one‑month review process.

ALGA lodged an initial submission on the draft order and is finalising a supplementary submission, drawing on input from councils and associations, to support participation in the Commission’s hearing scheduled for 25 May, 2026.
